Preamble

The present online shop offer is made by “Latium Olive Producers Organisation Agricultural Cooperative”, in compliance with applicable rules on e-commerce and distance contracts.

These General Terms and Conditions of Sale, hereinafter the “General Terms”, set out the terms and conditions for the sale of products marketed, hereinafter the “Products”, by Latium Olive Producers Organisation Agricultural Cooperative.

All contracts for the sale of Products by Latium Olive Producers Organisation Agricultural Cooperative to third parties, hereinafter the “Customers”, are governed by these General Terms, which form an integral and substantial part of every proposal, order and purchase confirmation relating to the Products. The terms of sale applicable to orders are those in force on the date of the order.

The Customer declares that they have read all the following information and general terms of sale before placing the order.

Products: prices and characteristics

Unless otherwise stated, prices of Products published on the site by Latium Olive Producers Organisation Agricultural Cooperative are in Euro and include VAT.

The price guaranteed to the buyer is that published on the Site when the order is submitted. The purchase price is fixed and final.

Prices of products published from time to time on the site by Latium Olive Producers Organisation Agricultural Cooperative cancel and replace previous ones and are subject to actual Product availability.

Product images are indicative and not binding.

The Customer is responsible for choosing the Products.

Orders and invoicing

Each order of Products sent to Latium Olive Producers Organisation Agricultural Cooperative constitutes a contractual proposal by the Customer. Fulfilment of the order by Latium Olive Producers Organisation Agricultural Cooperative equals confirmation and acceptance of it.

Tax documentation relating to the purchase of the Products ordered will be issued when the Products are shipped to the Customer. The Customer must request an invoice for the purchase of Products ordered, providing the exact billing details and specifying the address to which the invoice should be sent. If this does not happen, Latium Olive Producers Organisation Agricultural Cooperative will issue other tax documentation.

Order fulfilment

The order will be fulfilled within the timeframes stated on the Site. As a rule, deliveries within Italy take up to 7 working days for all Products marked as “available”.

If Latium Olive Producers Organisation Agricultural Cooperative fails to fulfil the order, the Customer will be informed as soon as possible of the expected delivery times. If the Customer does not wish to wait, in any case for no more than 30 working days, Latium Olive Producers Organisation Agricultural Cooperative will refund any amounts already paid for the unfulfilled supply.

Force majeure

The following are expressly considered cases of force majeure, in addition to those normally recognised in case law: total or partial strikes, internal or external to the company; blockage of transport or supply for any reason; government or legal restrictions; IT failures; telecommunications outages including networks and in particular the internet.

In the event of force majeure, fulfilment of the order will initially be suspended.

If after a period of 3 months the parties find that force majeure persists, the order will be automatically cancelled, unless otherwise agreed by both parties.

Order acceptance

The contract, i.e. acceptance of the order, is concluded only when Latium Olive Producers Organisation Agricultural Cooperative confirms the order. It reserves the right not to confirm an order for any reason, in particular product supply issues or formalisation of the order received.

 

Payment

Payment of the price is due when the order is submitted. The Customer undertakes to pay the agreed price for the Product ordered on the site, including transport costs. Accepted payment methods are Stripe and bank transfer.

The Customer warrants to Latium Olive Producers Organisation Agricultural Cooperative that they have any authorisations required to use bank transfer payment when placing an order. If Latium Olive Producers Organisation Agricultural Cooperative does not receive the transfer within 10 days of order confirmation, it may cancel the order. Bank details for the transfer will be provided when the order is placed.

The Customer warrants to Latium Olive Producers Organisation Agricultural Cooperative that they have any authorisations required to use Stripe payment when placing an order.

Ordered Products remain the property of Latium Olive Producers Organisation Agricultural Cooperative until their price has been paid in full (Art. 1523 et seq. Italian Civil Code). Latium Olive Producers Organisation Agricultural Cooperative reserves the right to reclaim products ordered in the event of non-payment.

Product delivery

Products are delivered to the address indicated by the Customer.

Shipments will take place after payment confirmation: for bank transfers, credit to the current account applies; for card payments, confirmation of the transaction by the payment network applies.

For shipments, Latium Olive Producers Organisation Agricultural Cooperative uses qualified express couriers.

Rates vary according to weight and destination of the shipment.

Delivery times

As a rule, deliveries within Italy take up to 7 working days for products available in stock.  Shipping times shown on the site, although carefully assessed, are not binding on Latium Olive Producers Organisation Agricultural Cooperative, which may subsequently confirm or change them according to its actual requirements.

Delivery delays of less than 30 days do not entitle the Customer to refuse delivery of the Products or to claim compensation or indemnities.

Delivery is deemed completed when the Product is delivered to the Customer. The delivery document issued by the carrier, dated and signed by the Customer on delivery of the Product, constitutes proof of transport and handover of the goods.

Latium Olive Producers Organisation Agricultural Cooperative recommends that the Customer, on delivery, checks the condition of the Products delivered before signing the delivery notice, in particular:

  • that the number of parcels delivered matches what is stated on the transport document or waybill attached to the shipment:
  • that the packaging is intact, not damaged, wet or oily or otherwise altered, and to check the integrity of the contents.

If the Customer finds any anomalies, they must refuse delivery of the products or set out their reservations in writing on the transport document and waybill, noting the anomalies identified, signed and dated.

If the courier document is signed without any note or reservation, the Customer may not raise any objection regarding the external condition of what was delivered.

Any issues concerning the physical integrity, correspondence or completeness of Products received must be reported to Latium Olive Producers Organisation Agricultural Cooperative within 3 days of delivery.

Therefore, for any insurance claim, Latium Olive Producers Organisation Agricultural Cooperative requires the Customer to provide:

– signed delivery note with reservation on inspection when unloading the goods;

– photos showing the outer packaging:

– photos showing the inner packaging:

– photos of the damage.

Unless otherwise stated, all deliveries are made at ground floor level.

Special delivery conditions and terms must be agreed in advance between the Customer and Latium Olive Producers Organisation Agricultural Cooperative.

Collection when the customer is absent

If the recipient is absent during delivery, the carrier will leave a notice at the delivery address indicated by the Customer. Products must be collected at the address and according to the methods indicated by the carrier. If not collected within the period set by the carrier, the Products will be returned to Latium Olive Producers Organisation Agricultural Cooperative, which reserves the right to refund the price of the Products, with shipping costs borne by the Customer.

Complaints

Claims regarding non-conformity of the Product(s) delivered with the order must be sent in writing directly to Latium Olive Producers Organisation Agricultural Cooperative immediately after receipt.

In the event of a product error, the Customer undertakes to return the Product or affected Products to Latium Olive Producers Organisation Agricultural Cooperative within 7 days of receipt, with sealed packaging, in their original condition and packaging and with accompanying documents.

Once the Product has been received in correct form, Latium Olive Producers Organisation Agricultural Cooperative will resend, at its own expense, the product originally ordered.

 

 

Right of withdrawal

  1. The Consumer has the right to withdraw from the contract and return the Products ordered, without penalty and without stating a reason, within 14 working days of receiving the Products.
  2. The right of withdrawal referred to above must be exercised by the Customer, on pain of forfeiture, by registered letter with return receipt to Latium Olive Producers Organisation Agricultural Cooperative SP Pascolare 87, 00018 Palombara Sabina (RM) Italy, within 14 working days of receipt of the Products, stating:
  • the intention to exercise the right of withdrawal under Article 52 of Legislative Decree 21/2014;
  • the products covered by the supply for which withdrawal is requested (if the Product consists of several components or parts, withdrawal cannot be exercised on only part of the product purchased);
  • your bank account details (bank name, IBAN code if a different refund method is chosen)
  1. All returns must be perfectly intact and include the original packaging.

The cost of shipping for returning products when exercising the right of withdrawal is borne by the Customer.

The Product must be shipped to the following address: Latium Olive Producers Organisation Agricultural Cooperative SP Pascolare 87, 00018 Palombara Sabina (RM) Italy.

Cash on delivery parcels will not be accepted.

  1. Latium Olive Producers Organisation Agricultural Cooperative will refund the Customer within 14 days of receipt of the registered letter by which the right of withdrawal was exercised, for the cost of the Products returned, using the same payment method used by the Customer for the initial transaction, unless the Customer has expressly indicated a different payment method:
  • in that case, state in the registered letter exercising the right of withdrawal your bank account details with bank name and IBAN code.
  1. The right of withdrawal may not be exercised by the Customer where the Products purchased consist of bottles and/or cans of Italian EVO oil that have been opened by the Customer, or where items sold have been ordered and produced or customised expressly on the customer’s order.
  2. Under Legislative Decree 21/2014 (Art. 56), Latium Olive Producers Organisation Agricultural Cooperative may withhold the refund until receipt of the goods or until the Customer proves that the goods have been sent back.
  3. During the withdrawal period referred to in point 1, the Customer is responsible as bailee. If the Product is damaged or destroyed while in the Customer’s custody, the right of withdrawal will lapse.

 

Applicable law and jurisdiction

These General Terms are governed by Italian law and must be interpreted in accordance with Italian law.

For disputes arising from the interpretation, validity and/or performance of these General Terms, the exclusive territorial jurisdiction shall be the courts of Rome.
